When something is done with data pertaining to a person, it is processing of personal data. Processing of personal data is collecting personal data alone, but also saving, archiving, forwarding, disclosing, and destroying. Personal data are any data regarding the person identified or to be identified, regardless of the state or form that the data is in.
Personal data handling in employment relationships is characterized by opposite interests and basic rights, legal norms with high abstract level, and the mixing of private and public law.
Mutual trust is the basis of a good employment relationship. Therefore, handling personal data on the principle – processing at the employee’s knowledge – has a central importance in employment relationships.
If the employer or employee have any concerns regarding the legality of the personal data collection or preservation, they are entitled to turn to the Estonian Data Protection Inspectorate for assistance.
