Working Time Limitations for Night Workers

According to working time limitations for night shifts, the night worker may not work more than 8 hours during a 24-hour time period (7-day calculation period). According to law, when calculating the medium working time for night workers, the 24-hour period must be subtracted from the 7-day calculation period (7 days - 1day = 6 days).

Emanating from the aforementioned, a night worker may work 48 hours, at the maximum, during a 7-day calculation period (on the average, 8 hours per day in 6 days). This means that the amount of working hours per 7 days may not exceed 48 hours, regardless of whether the shifts of the specific week fall onto night or day time. In a 24-hour period, a night worker must have at least 11 consecutive hours of resting time, and at least 48 consecutive hours of resting time per 7 days.

Law prescribes a stricter limitation for such night workers whose health is greatly influenced by the working environment risk factors or the nature of work. Such a night worker may not work more than 8 hours during a 24-hour time period. This is an absolute limitation – it is irrelevant whether the shifts of the specific week fall onto night or day time. In a 24-hour period, the number of working hours may not exceed 8.

Employer is obliged to execute a risk assessment for each position and organize medical checks to night workers both before beginning the night shifts as well as after regular intervals.

In certain cases, exceptions can be made concerning the night worker with the employment contract or collective agreement. Exceptions are allowed on conditions that working does not damage the health and safety of employees and the working time does not exceed the allowed working limitation. This applies primarily to such positions related to security or safeguarding activities, actions that require the constant service or manufacturing, also services related to health care and welfare and for harbour and airport employees.
