Strike or Lock-Out Notice, Postponement or Stopping

Strike is a suspension of work that takes place at the initiative of employees or a trade union in order to achieve the goals set during the collective bargaining. The decision to organize a strike shall be made by the general meeting of employees or by the trade union. Participation at the strike is voluntary, and it is forbidden to block non-involved employees from working.

Lock-out is the suspension of work that takes place at the initiative of employer or the federation of employers to achieve the goals set during the collective bargaining. The decision to organize a lock-out shall be made by the employer.

The organizer must inform about the planned strike or lock-out the other party, conciliator and local government in writing at least two weeks in advance. The notice must list the reasons, precise start time, and possible extent of the strike or lock-out.

The strike shall be led by the person appointed by the employees’ general assembly that decided to have a strike (i.e., the strike leader). The strike leader must adopt measures to the assets of the other party, guarantee legitimacy and public order, being responsible for any accompanied offences and caused damage. The lock-out shall be led in the order specified by the employer.

The start time of the strike or lock-out may be postponed only once – by one month at the proposal by the Public Conciliator, or by two weeks at the proposal of the local conciliator. The Government of the Republic is entitled to end the strike or lock-out during a natural disaster, catastrophe, to prevent the spread of infectious diseases, and in the state of emergency.

According to the Civil Service Act that took effect of April 1st, 2013, an official may not strike nor participate in other collective pressure activities that disrupt the work of the institution employing the official, nor the work of some other institution. The pressure activity is collective, if at least half officials wish to participate. In a company satisfying the prime necessities of the citizens and economy, and in institution where a strike limitation applies, must internally agree the minimum required service or production volume.
