Employment Contract Termination Invalidity

Terminating an employment contract without a legal basis or by violating legal requirements is invalid.

Employment contract termination must:

  • Be based on the termination reason and no termination excluding circumstances may occur;
  • Correspond to the legal form requirements, e.g. presented in a written and reproducible form.

If the employment contract cancellation does not correspond to the aforementioned requirements, the termination is invalid. Termination without a legal basis or not compliant with legal requirements is invalid.

One should turn to the labour dispute committee or court for reinstating an employment contract that was terminated without a legal basis or without complying to legal requirements.
